OVERVIEW

This website is operated by Miss Daisy's Consignment & Auction House, a business associated with Moving Miss Daisy LLC. Throughout this website, the terms "Miss Daisy's," "we," "us," and "our" refer to Miss Daisy's Consignment & Auction House.

We operate a physical resale showroom in Santa Barbara, California, and offer an online catalog through Shopify.

Our website, merchandise, information, tools, and services are offered subject to your acceptance of these Terms of Service and any additional policies referenced herein.

By accessing our website or purchasing merchandise, you agree to these Terms of Service.

Our Shopify platform is provided by Shopify Inc., which supplies the technology enabling online transactions.

These Terms apply to all website visitors and purchasers. Additional store-specific policies may apply to consignors, contractors, vendors, and service providers under separate agreements.

SECTION 1 — ONLINE STORE TERMS

By using this website or completing a purchase, you represent that you are at least the age of majority in your jurisdiction or otherwise have the legally required consent to enter into the transaction.

You agree not to use our website, merchandise, or services for unlawful or unauthorized activities.

You may not transmit viruses, malicious software, or destructive code through the website.

We reserve the right to restrict or terminate website access when these Terms have been violated, subject to applicable law.

SECTION 2 — OUR PHYSICAL STORE & ONLINE INVENTORY

Miss Daisy's is primarily a brick-and-mortar consignment and resale business.

Our online merchandise catalog is provided as an additional convenience and does not guarantee that every item displayed remains available.

Because our physical showroom and online catalog share inventory, merchandise may sell in-store before online inventory quantities update.

In these circumstances, we reserve the right to cancel the affected portion of an order and refund the corresponding payment.

Store and online prices, discounts, promotions, and availability may differ.

Merchandise marked for special in-store promotions or clearance may not appear online or may have different pricing.

Customers are encouraged to contact the showroom directly with questions regarding availability, merchandise condition, measurements, or prices before placing an order.

SECTION 3 — GENERAL CONDITIONS

We reserve the right to refuse or limit transactions for legitimate business reasons, subject to applicable law.

You may not reproduce, duplicate, sell, resell, exploit, or commercially distribute any portion of our website or its content without prior written authorization.

Information transmitted over electronic networks may pass through third-party systems. Payment information is handled through applicable payment-processing services and their security systems.

Section headings are provided for convenience and do not alter the meaning of these Terms.

SECTION 4 — ACCURACY OF WEBSITE INFORMATION

We make reasonable efforts to keep our website accurate and current.

However, online information may occasionally contain incomplete descriptions, inaccurate measurements, incorrect quantities, outdated prices, photographic variations, or other errors.

Images may not fully represent an item's actual color, texture, dimensions, condition, or appearance.

Product photographs and descriptions are intended to assist buyers, not replace physical inspection.

We may modify website information as needed, subject to applicable law and our obligations regarding completed transactions.

SECTION 5 — PRICING, AVAILABILITY & LISTING ERRORS

Merchandise prices may change without notice before purchase.

Occasionally, items may be listed prematurely or with incorrect pricing due to data entry, software synchronization, or other technical issues.

This may include unintended prices of $0.00 or other obvious pricing errors.

If we discover a material listing error or that merchandise is unavailable, we reserve the right to cancel the affected order and refund the corresponding payment.

We may contact the customer to explain the issue or offer an alternative when appropriate.

A submitted order does not guarantee fulfillment when inventory is unavailable or the listing contains a material error.

SECTION 6 — PAYMENT METHODS & PROCESSING FEES

Online purchases are processed through the payment methods offered by our Shopify checkout.

Miss Daisy's incurs payment-processing expenses when customers pay electronically. We seek to recover these business costs through our pricing and payment policies.

Our current electronic payment-processing cost is approximately 2.9%.

Any payment-related charge imposed on customers must be consistent with applicable law, payment-network requirements, and the pricing disclosed to customers.

Where a payment fee is optional and permitted, the applicable fee must be clearly disclosed before payment and must not exceed permitted limits.

Where an electronic payment fee is unavoidable for an online purchase, it must be reflected in the advertised price to the extent required by law.

Customers purchasing directly from our physical showroom may have additional payment options, including cash or check, subject to store policies.

Applicable sales tax is charged as required by law.

SECTION 7 — ALL SALES FINAL

ALL SALES ARE FINAL. ALL MERCHANDISE IS SOLD AS IS, WHERE IS, WITH ALL FAULTS.

Miss Daisy's specializes in pre-owned, vintage, antique, consigned, estate, and other resale merchandise.

Items may exhibit wear, fading, discoloration, repairs, alterations, restoration, scratches, dents, missing components, age-related changes, or other imperfections.

Some defects may not be readily visible in photographs or described individually in listings.

Except where required by law or expressly authorized by Miss Daisy's, we do not provide refunds, returns, exchanges, or store credit for:

  • Buyer's remorse or a change of mind.

  • Personal preferences regarding color, style, or appearance.

  • Merchandise that does not fit a customer's intended space.

  • Condition issues consistent with the item's sale as pre-owned merchandise.

  • A customer's decision to purchase without physically inspecting the item.

Nothing in this policy excludes rights or remedies that cannot lawfully be waived, including applicable protections concerning misrepresentation or materially incorrect merchandise.

SECTION 8 — SIGHT-UNSEEN PURCHASES & CONDITION ACCEPTANCE

We strongly encourage customers to inspect merchandise in person before purchase.

Customers who purchase online without inspecting their merchandise acknowledge the inherent risks associated with purchasing previously owned items.

Descriptions, photographs, and dimensions are provided in good faith, but may not identify every characteristic or imperfection.

Customers acknowledge that age, prior ownership, previous repairs, wear, and variations in materials may affect merchandise appearance or functionality.

By purchasing without an in-person inspection, the customer accepts those risks, subject to applicable law.

Failure to inspect merchandise before purchase does not, by itself, establish grounds for cancellation or refund.

Customers should request additional photographs, measurements, or condition information before completing a purchase when these details are important to their decision.

SECTION 9 — NO IN-HOUSE SHIPPING OR DELIVERY

MISS DAISY'S DOES NOT PROVIDE IN-HOUSE SHIPPING OR DELIVERY.

All online merchandise must be collected from our Santa Barbara showroom.

Customers are responsible for arranging and paying for transportation, shipping, packing, delivery, or other collection services.

Customers may independently engage professional movers, shipping companies, family members, or other authorized representatives.

Any transportation or shipping agreement is between the customer and the independent service provider.

Miss Daisy's is not the carrier, shipper, or transportation contractor for these arrangements.

Shipping insurance, protective packing, handling requirements, and transportation costs are the customer's responsibility.

SECTION 10 — 72-HOUR PICKUP REQUIREMENT & STORAGE

All online purchases must be picked up within 72 hours of purchase, unless Miss Daisy's has approved an extension or pickup hold.

Customers are responsible for arranging appropriate vehicles, labor, packing, equipment, and any necessary professional assistance.

If merchandise remains uncollected after 72 hours, storage charges of $10 per day, per item may begin accruing.

A qualifying pair purchased together is treated as one item for storage-charge purposes.

Storage charges are intended to offset the cost of occupying limited showroom or storage space beyond the standard collection period.

Approved pickup holds suspend the applicable pickup deadlines and storage charges for the approved hold period.

Customers anticipating a pickup delay should contact Miss Daisy's before the 72-hour deadline.

Failure to collect merchandise does not automatically entitle the customer to a refund.

Extended Delays & Uncollected Merchandise

Miss Daisy's may send reminders and notices regarding merchandise awaiting pickup.

Orders remaining uncollected for 30 days may be reviewed for cancellation and further action.

No automatic cancellation, resale, forfeiture, or disposal occurs solely because 30 days have elapsed. Any such action requires store authorization and compliance with applicable notice, property, and consumer-protection laws.

Storage charges and other lawful obligations may remain payable as applicable.

SECTION 11 — THIRD-PARTY PICKUP & AUTHORIZED REPRESENTATIVES

Customers may designate an independent mover, shipping company, family member, friend, or other representative to collect purchased merchandise.

When a customer authorizes a third party to collect an order:

  1. The representative acts as the customer's authorized agent for receiving the merchandise.

  2. The representative may inspect the merchandise and acknowledge its condition upon collection.

  3. Release of the merchandise to the authorized representative constitutes delivery to the customer.

  4. The customer is responsible for arranging appropriate transportation, equipment, protective materials, and labor.

  5. Miss Daisy's is not responsible for loss or damage caused by independent transportation or shipping providers after the merchandise has been released to the authorized representative.

We may require order identification, purchaser authorization, or other reasonable verification before releasing merchandise.

Customers should ensure that their designated representatives understand the merchandise dimensions, weight, condition, and handling requirements.

Nothing in this section limits liability that cannot legally be excluded.

SECTION 12 — MERCHANDISE AWAITING PICKUP

Miss Daisy's operates an active retail showroom.

Purchased merchandise may remain on display or in its existing showroom location until prepared for pickup.

Certain merchandise may continue to receive ordinary display or showroom use while awaiting collection.

We will exercise reasonable care of merchandise held for pickup.

Customers acknowledge that showroom merchandise may be handled during normal business operations.

This provision does not excuse negligence, damage, or other responsibilities that cannot be lawfully waived.

SECTION 13 — BILLING INFORMATION & ORDER VERIFICATION

Customers agree to provide complete, accurate, and current billing and contact information.

We may contact purchasers to verify an order, confirm pickup arrangements, resolve a listing error, or address payment concerns.

We reserve the right to cancel, limit, or refuse orders involving suspected fraud, materially inaccurate information, unavailable merchandise, or other legitimate business concerns, consistent with applicable law.

Customers are responsible for keeping contact information current so that pickup reminders and important order communications can be delivered.

SECTION 14 — THIRD-PARTY SERVICES, TOOLS & LINKS

Our website may use or link to services provided by independent third parties, including Shopify, payment processors, transportation companies, and other technology providers.

These third parties may operate under their own terms, privacy policies, and service conditions.

Miss Daisy's does not control independent third-party websites, systems, or services.

Customers using third-party providers should review the applicable provider's terms before engaging their services.

We are not responsible for independent third-party conduct except where applicable law provides otherwise.

SECTION 15 — CUSTOMER COMMENTS, REVIEWS & SUBMISSIONS

Customers may submit reviews, comments, photographs, questions, or other information through our website or related communication channels.

By voluntarily submitting content for publication or promotional use, customers represent that they have the right to share that material and that it does not unlawfully infringe another person's rights.

We may moderate or remove content that violates applicable law, contains malicious code, infringes intellectual property rights, or is otherwise inappropriate for our website.

We will not intentionally publish confidential customer information without appropriate authorization.

Our use of personal information remains subject to our Privacy Policy and applicable law.

SECTION 16 — PERSONAL INFORMATION & PRIVACY

Customer personal information is handled in accordance with our published Privacy Policy and applicable privacy laws.

Information collected during online purchases may include names, contact details, billing information, order information, and pickup-related details.

Payment processing may be performed by independent payment providers.

For information about data collection, use, disclosure, and applicable consumer rights, please review our separately published Privacy Policy.

SECTION 17 — PROHIBITED USES

Customers and visitors may not use our website or services to:

  • Engage in illegal activities.

  • Submit fraudulent or misleading information.

  • Infringe intellectual property or privacy rights.

  • Harass, threaten, or abuse others.

  • Transmit malicious code, viruses, or harmful software.

  • Attempt unauthorized access to website accounts or systems.

  • Interfere with website security or operation.

  • Collect personal information unlawfully.

  • Conduct unauthorized automated scraping or data extraction.

  • Circumvent transaction, payment, or security controls.

We may restrict website access or take other lawful action when these provisions are violated.

SECTION 18 — DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Our website and related online services are provided on an "as available" basis.

We do not guarantee uninterrupted access, error-free operation, or continuous availability of online services.

Resale merchandise is offered in its existing condition, subject to applicable law and any express representations made by Miss Daisy's.

To the fullest extent permitted by law, Miss Daisy's disclaims warranties that may lawfully be excluded and limits liability for indirect, incidental, special, or consequential losses arising from the use of our website or services.

These limitations do not exclude liability for fraud, intentional misconduct, gross negligence, or any other matter for which liability cannot legally be limited.

Nothing in these Terms removes statutory consumer protections or rights that cannot lawfully be waived.

SECTION 19 — INDEMNIFICATION, SEVERABILITY & TERMINATION

To the extent permitted by law, users agree to indemnify Miss Daisy's against third-party claims arising from their unlawful use of the website, infringement of another person's rights, or material breach of these Terms.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent legally permitted.

We may restrict or terminate access to our website for violations of these Terms or other legitimate reasons consistent with applicable law.

Obligations that properly survive termination, including outstanding payment obligations and other enforceable contractual responsibilities, will remain effective.

SECTION 20 — GOVERNING LAW, CHANGES & CONTACT INFORMATION

These Terms of Service are governed by the applicable laws of the State of California and the United States, subject to any mandatory consumer protections that apply.

We may update these Terms periodically by publishing a revised version on our website.

The version applicable to a completed purchase is generally the version presented or incorporated into the transaction at the time of purchase, unless otherwise agreed or required by law.

These Terms, together with any applicable referenced policies and express written transaction agreements, constitute the agreement governing purchases through our online store.
